Law Enforcement Guidelines

Information for law enforcement agencies regarding legal requests for user data.

1. Introduction

Lushme is committed to cooperating with law enforcement agencies while protecting the privacy and rights of our users. These guidelines provide information for law enforcement officials seeking user data or account information from Lushme.

Lushme will only disclose user information in response to valid legal process or in emergency situations as described in these guidelines. We carefully review each request to ensure it complies with applicable laws and our policies.

These guidelines do not create any enforceable rights for third parties. Lushme reserves the right to update these guidelines at any time.

2. Types of Legal Process We Accept

Subpoenas: A valid subpoena issued in connection with an official criminal investigation may compel the disclosure of basic subscriber information, including name, email address, account creation date, last login date, and IP address logs.

Court Orders: A court order issued under applicable law may compel the disclosure of records beyond basic subscriber information, including message metadata, connection history, profile information, and other non-content records.

Search Warrants: A valid search warrant issued by a court of competent jurisdiction upon a showing of probable cause is required for the disclosure of the contents of communications, including messages, photos, and other user-generated content.

All legal process must be properly served and must be specific and narrowly tailored. We may object to overly broad or vague requests.

3. Emergency Requests

Lushme may voluntarily disclose user information to law enforcement without legal process when we believe in good faith that an emergency involving danger of death or serious physical injury to any person requires immediate disclosure of information.

Emergency requests must be submitted by a verified law enforcement official and should include a detailed description of the emergency, the specific information requested, and an explanation of why the information is needed to address the emergency.

Emergency requests should be submitted to legal@lushme.app with the subject line "EMERGENCY DISCLOSURE REQUEST" and will be reviewed on a priority basis. Lushme makes the final determination on whether to comply with any emergency request.

4. Data Preservation Requests

Law enforcement agencies may request that Lushme preserve user account information pending the issuance of formal legal process. Preservation requests must be submitted on official law enforcement letterhead and must identify the specific user account and the specific data to be preserved.

Lushme will preserve a snapshot of the specified account records for 90 days. A subsequent preservation request may extend the preservation for an additional 90 days. Preserved records will be disclosed only upon receipt of valid legal process.

Preservation requests do not compel Lushme to disclose any user data. They only ensure that specified data is not deleted during the preservation period.

5. User Notification

It is Lushme's policy to notify users about law enforcement requests for their information before disclosing that information, unless we are legally prohibited from doing so or in cases where providing notice could be counterproductive (e.g., cases involving child exploitation, emergency situations, or when notice has been waived by the court).

If a law enforcement request is accompanied by a valid non-disclosure order, Lushme will not notify the affected user for the duration specified in the order. Upon expiration of the non-disclosure order, Lushme may notify the user.

6. Submission Guidelines

All law enforcement requests must be submitted in writing on official agency letterhead and must include the requesting agent's name, badge number, direct contact phone number, email address, and the law enforcement agency's name and full address.

Requests should clearly identify the specific Lushme user account(s) at issue (by username, email address, or user ID) and the specific information sought.

All requests and legal process should be directed to: legal@lushme.app. Please include "Law Enforcement Request" in the subject line.

Lushme does not accept requests submitted by non-law enforcement personnel. Private parties seeking user information should consult applicable civil discovery procedures.

7. Response Times

Lushme strives to respond to valid law enforcement requests in a timely manner. Standard requests are typically processed within 10 to 14 business days from the date of receipt of valid legal process.

Emergency requests involving imminent threat to life or serious physical injury are reviewed and responded to on a priority basis, typically within 24 hours.

Preservation requests are typically acknowledged within 3 business days.

Complex requests or requests requiring additional legal review may take longer. Lushme will communicate expected timelines when additional time is needed.

8. International Requests

Law enforcement agencies outside of the jurisdiction where Lushme operates may submit requests through established international cooperation mechanisms, such as mutual legal assistance treaties (MLATs), letters rogatory, or other recognized international legal frameworks.

We may respond directly to international law enforcement requests where the requesting agency provides valid legal process recognized under applicable law and the request is consistent with internationally recognized standards of due process.

Lushme reserves the right to decline requests that do not meet applicable legal standards or that are inconsistent with the principles of international human rights law.
